AT THE REFERENDUM

1 .THE DRAFT ALLOWS APPLICATION OF INTERNATIONAL AGREEMENTS WITHOUT APPROVAL BY PARLIAMENT
If this draft constitution passes, then foreign laws, some which are un-Biblical and unethical, will be introduced in our country through Article 2 (6). These could undermine our sovereignty and are loopholes for the legalization of abortion and homosexuality.
2. THE DRAFT ALLOWS THE STATE TO INTERFERE WITH RELIGION
If this draft is passed without the provision that "State and religion shall be separate" in Article 8, it will allow the government to pass laws that favour one religion against others. Remember that in Daniel 6:1-28, a law was passed that made it illegal to pray or worship God.
3. THE DRAFT ALLOWS THE GOVERNMENT TO FAVOUR SOME RELIGIONS
If the draft is passed without the provision that "The State shall treat all religions equally" in Article 8, the government will be allowed to favour some religions and victimise others.
4. THE DRAFT TAKES AWAY THE RIGHT TO PREACH / EVANGELIZE
If the draft is passed with Article 32 as it is, Christians will not have the right to preach their faith to other people and make converts. It will be very difficult to obey the command Jesus gave in Matthew 28:19.
5.THE DRAFT TAKES AWAY THE RIGHT OF KENYANS TO CONVERT FROM ONE RELIGION TO ANOTHER
If the draft is passed with Article 32 as it is, Kenyans who convert from one religion to another will not have constitutional protection from persecution.
6. THE DRAFT ALLOWS RELIGIOUS INSTITUTIONS TO BE INFILTRATED BY NON-BELIEVERS
If the draft is passed as it is, Article 32 (3) will force churches and other religious facilities and institutions to employ and give access to people of other faiths. Can you imagine having a pastor who is not a Christian? God in 2 Chronicles 23: 6 requires that we maintain the sanctity of churches and all private institutions.
7. THE DRAFT DOES NOT MAKE KENYANS EQUAL BEFORE THE LAW
If the draft is passed as it is, then there will be two classes of people in Kenya: Kenyans and Muslims. This is because Muslims are exempted from the Bill of Rights by Article 24 (4). All Kenyans should be equal before the law.
8. THE DRAFT ENTRENCHES KADHI'S COURTS EVEN THOUGH THE HIGH COURT SAID THEY ARE UN-CONSTITUTIONAL
The landmark ruling by the High Court on 24th May 2010 said that inclusion of Kadhi's Courts in the Constitution is discriminatory, illegal and unconstitutional! In disregard of this ruling, the draft in Articles 169 and 170 entrenches them. The Kadhi's Courts are an internal dispute resolution mechanism for Muslims, and therefore they should not be in the constitution. The High Court also said that the government should not use tax payers' money to maintain the Kadhi's Courts or pay their salaries. If the Kadhi's Courts are not constitutional in the current constitution, why should they be put in the new constitution?
9. THE DRAFT ALLOWS ABORTION
If the draft is passed as it is, then doctors, nurses, clinical officers, mortuary attendants and even first aid attendants will be allowed by Articles 26 (4) to carry out abortions for all manner of reasons. Why should Kenyan children be killed so casually? Abortion is murder of children, and it contradicts Exodus 20: 13 ("You shall not murder").
10. THE DRAFT CONSTITUTION IS ALMOST IMPOSSIBLE TO AMEND
Do not be deceived that you can pass this draft then change it later. Once you pass the draft, Section 257 ensures that you will never be able to fulfill what it takes to amend it. You will require 2/3 majority in senate and national assembly; 1,000,000 signatures; and a referendum. Why are Kenyans being pushed to pass something hurriedly if it has some bad elements on the promise that they will change it later? Why not change it now? BEWARE OF ANTHING THAT ANYONE PUSHES YOU TO PASS HURRIEDLY. HARAKA HARAKA HAINA BARAKA!!

All Kenyans should remember that the way to prosperity of the nation is by embracing justice. The Bible in Deuteronomy 16: 20 says: "Follow justice and justice alone, so that you may live and possess the land the Lord your God is giving you.
